Welcome DumbBlonde.ca (the "Site"). These Terms and Conditions ("Terms") govern your access to and use of the Site and all services provided by Dumb Blonde Energy & Bakery ("we," "us," or "our").
By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Site or use our services.
1. Use of the Site
A. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use this Site and place orders or book events.
B. User Obligations
You agree not to use the Site for any unlawful purpose or any purpose prohibited by these Terms. This includes, but is not limited to:
1. Violating any applicable local, provincial, national, or international law.
2. Collecting or storing personal data about other users without their express consent.
3. Transmitting any unauthorized advertising, promotional materials, or any other form of solicitation (spam).
2. Bakery Pre-Orders and Event Bookings
A. Ordering and Availability
All bakery item pre-orders and event bookings are subject to availability. We reserve the right to limit the quantities of any products or services that we offer.
B. Pricing and Payment
1. Pricing: Prices for our products and services are subject to change without notice. All prices listed are in Canadian Dollars (CAD) unless otherwise stated.
2. Payment Methods: Currently, all payments for pre-orders and event bookings must be completed off-Site via e-transfer or cash deposit as arranged with us. No credit card information is collected or processed on this Site.
3. Payment Due: Full payment or deposit (as specified at the time of order/booking) must be received by the stated deadline to confirm your order or reservation. Failure to pay on time may result in cancellation.
C. Cancellations and Refunds
Pre-Orders: Cancellation of bakery pre-orders must be made at least 48 hours prior to the scheduled pickup/delivery time to be eligible for a full refund of any deposited funds.
Event Bookings: Cancellation policies for events may vary. Specific cancellation and refund terms will be provided at the time of booking confirmation.
Our Right to Cancel: We reserve the right to cancel any order or booking at our discretion, in which case a full refund will be issued.
D. Product Disclaimer
Due to the nature of our products (baked goods), we cannot guarantee exact uniformity in appearance. We also note that our products may contain or come into contact with common allergens (e.g., wheat, nuts, dairy, soy). It is the customer's responsibility to notify us of any allergies.
3. Intellectual Property
The Site and its original content, features, and functionality are and will remain the exclusive property of Dumb Blonde Energy & Bakery and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Dumb Blonde Energy & Bakery.
4. Disclaimers and Limitation of Liability
A. Disclaimer of Warranties
The Site and all services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, or materials included on the Site.
B. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Dumb Blonde Energy & Bakery, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
1. Your access to or use of or inability to access or use the Site or services;
2. Any content obtained from the Site; and
3. Unauthorized access, use, or alteration of your transmissions or content.
5. Governing Law
These Terms shall be governed and construed in accordance with the laws of New Brunswick and the federal laws of Canada, without regard to its conflict of law provisions.
6. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms.
